Terms & Conditions: Weaving Magic with Web Weaver Wizard

Welcome to Web Weaver Wizard! We're thrilled you're considering us to conjure up your perfect online presence. These Terms & Conditions (or "T&Cs" as we like to call them, keeping things friendly!) outline our magical partnership, ensuring clarity and transparency every step of the way. By engaging with our services, you agree to these terms. So grab a cuppa, get comfy, and let's unravel the good stuff!

Your Digital Dream Team: Web Weaver Wizard is currently trading as a sole trader from Sculpins Lane, Braintree. All of our work is conducted online, with the exception of any client meetings. 

1. The Spellbinding Scope of Our Services

We're here to design, develop, and deliver exceptional websites that promote your services. Every project is unique, and we'll discuss your specific needs in detail during our initial (and always delightful!) scoping meeting. This can be held in person, over the phone, or virtually via Zoom – whatever works best for your schedule.

  • Project Proposal: Following our scoping meeting, we'll provide a detailed project proposal outlining the agreed scope of work, key deliverables, and a full quotation. This proposal, once accepted by you, forms part of our agreement.

  • Timeframes: We'll discuss and agree on realistic timeframes for your project's completion during our initial meeting and confirm them in your project proposal. We pride ourselves on timely delivery, but sometimes magic takes a moment!
     

2. Your Intellectual Property & Ours (The Magic Ingredients!)
 

  • Your IP: We understand your business is your brainchild! You guarantee that any intellectual property (IP) – such as text, images, logos, or brand guidelines – you provide to us for use in your website is either owned by you or that you have the necessary licenses and permissions to use it. You agree to indemnify us against any claims arising from the use of materials you provide.

  • Our IP (The Secret Sauce!): Where Web Weaver Wizard creates unique designs, code, graphics, or other elements specifically for your project (and which are not pre-existing proprietary methodologies of Web Weaver Wizard), upon final payment, the intellectual property rights for these specific deliverables will be transferred to you. However, we retain the right to use our pre-existing tools, methodologies, and general know-how, and we may use your completed website in our portfolio to showcase our awesome work (unless you explicitly request otherwise, in writing, at the start of the project).
     

3. Confidentiality & Non-Disclosure (Our Oath of Secrecy)

We understand that building a website can involve sharing sensitive business information. Consider us your trusted digital confidantes!
 

  • Our Commitment: Web Weaver Wizard (and our team) promises to keep all confidential information you share with us strictly confidential. This includes, but isn't limited to, your business plans, trade secrets, customer lists, and any sensitive data you entrust to us during the project. We will not disclose this information to any third party or use it for any purpose other than to fulfil our obligations for your project.

  • Exceptions: This confidentiality doesn't apply to information that is already publicly known, becomes public through no fault of ours, is legally required to be disclosed, or is obtained by us from a third party without breaching confidentiality.

  • Duration: Our commitment to confidentiality continues even after your project is completed.
     

4. Payments & Pricing (The Fuel for Our Magic!)
 

  • Pricing Structure: Our basic website services start from £595. However, as every website is a custom creation, a full and final quotation will be provided after our scoping meeting, tailored to your specific project needs and the amount of IP we need to create for you.

  • Payment Terms: To get our wands ready and the magic flowing, we require a 75% upfront payment before commencing any design or development work. The remaining 25% balance will be due upon completion of the website, prior to its final launch or handover.

  • Invoicing: Invoices will be sent to you electronically. Payment is expected within 14 days of the invoice date.

  • Late Payments: We understand that sometimes things can get tricky, so please communicate with us if you anticipate any delays. However, please note that late payments may incur statutory interest as per UK law, and further work on your project may be paused until outstanding payments are settled.
     

5. Our Guarantee & Refund Policy (Your Peace of Mind!)

We're confident you'll love the website we weave for you, but your satisfaction is paramount!
 

  • Our "Love Your Website" Guarantee: We guarantee that our website will meet the agreed-upon specifications outlined in your approved project proposal.

  • 100% Refund within 7 Days: If, for any reason, you are genuinely unhappy with the final completed website(as per the agreed scope) within one week (7 calendar days) of its completion and handover, we will offer a 100% refund of all payments made to us for that specific project.

    • How it Works: To claim a refund under this guarantee, you must notify us in writing (email is fine) within the 7-day period, clearly stating your reasons for dissatisfaction. Upon receiving your refund, all rights and ownership of the website and any associated design files created by Web Weaver Wizard for that project will revert to Web Weaver Wizard, and you agree to cease using the website. We will then take the website offline.

    • Please Note: This guarantee applies to dissatisfaction with the final website delivery based on the agreed scope, not changes to the scope once the project is underway, or delays caused by you.
       

6. Revisions & Amendments (Tweaks & Sparkles!)

The project proposal will outline the number of revision rounds included in your package. While we aim for perfection, sometimes extra tweaks are needed. Extensive revisions beyond the agreed scope may be subject to additional charges, which will always be discussed and agreed with you beforehand.
7. Our Promise & Your Responsibilities

  • Our Promise: We promise to use reasonable care and skill in providing our services, to communicate clearly and promptly, and to act in your best interests to deliver a fantastic website.

  • Your Responsibilities: To ensure a smooth and speedy project, we'll need your timely feedback, approvals, and provision of content (text, images, etc.) as agreed. Delays in receiving these may impact the project timeline.
     

8. Data Protection & Privacy (Your Info is Safe!)

We take your privacy seriously. Any personal data you provide to us will be collected, stored, and processed in accordance with our Privacy Policy, which you can find at the Privacy Policy Page.  This policy outlines how we comply with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

9. Links to Third-Party Websites

Our website or your completed project may contain links to third-party websites or services that are not owned or controlled by Web Weaver Wizard. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

10. Limitation of Liability

While we strive for digital perfection, we cannot guarantee that your website will be entirely uninterrupted or error-free. To the fullest extent permitted by UK law, Web Weaver Wizard shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of our services. Our total liability to you for any claim arising from our services shall not exceed the total amount paid by you to Web Weaver Wizard for the specific project in question. Nothing in these T&Cs limits or excludes our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

11. Changes to These Terms

We may update these T&Cs from time to time to reflect changes in our services or legal requirements. The most current version will always be available on our website. For ongoing projects, we will notify you of any significant changes.

12. Governing Law & Jurisdiction

These Terms & Conditions, and any disputes or claims arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the law of England and Wales. Both parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these T&Cs or their subject matter.
